6/14/18-Nat’l Audubon Executes Great Salt Lake Death Warrant

This section contains documents generated by our Great Salt Lake Working Group during the Spring of 2018 --

(1) A 3/31/2018 notice to all of our 150 members soliciting their participation in the revival of our Great Salt Lake Working Group.

(2) A 4/7/2018 e-mail to the Executive Director of the National Audubon Society’s Saline Lakes Program after she refused to meet with us but invited us to “please feel free to reach out to me with your questions.” As invited, our 4/7/2018 e-mail contained our questions. However, the Executive Director refused to answer any of them.

(3) A 4/24/2018 letter to National Audubon Society CEO David Yarnold (with a copy to the CEO General Counsel) describing all of the efforts of our Great Salt Lake Working Group 2016-2017 enclosing copies of the salient documents that were generated between 10/31/2016 and 4/5/2017. [The letter did NOT mention the behavior of the Executive Director of the Saline Lakes Program.] The stated purpose of the letter, since we had been the only organization to advocate litigation to save Great Salt Lake and the National Audubon Society had announced during the summer of 2017 that it would engage in such litigation though none had been instituted in the ensuing year, was “whether your organization would be willing to permit any donors we might solicit to make contributions directly into a special fund or restricted account that would only be used to finance the litigation.” The 4/24/2018 letter invited CEO David Yarnold and his General Counsel to breakfast or lunch at the Harvard Club of NYC on either Thursday May 10 or Friday May 11 to discuss this matter. Nothing has been heard from either CEO David Yarnold or his General Counsel.

(4) A 6/14/2018 letter to each of the Members of the Board of Directors of the National Audubon Society apprising them that CEO David Yarnold and his General Counsel refused to permit “ear marked” contributions and, as a result, John Karls was forced on Friday afternoon May 11 and Saturday morning May 12 to steer two friends, each of whom was ready to write an 8-figure check to charity, to other causes.

Earlier this morning (June 14), an identical 4-page letter was sent to each of 11 members of the Board of Directors of the National Audubon Society for whom a physical address could be ascertained. Here is a sample of that letter --

The attached letter was received earlier this evening by e-mail from the National Audubon General Counsel in reaction to our 6/13/2018 communications to the members of the National Audubon Board of Directors.

She and National Audubon CEO David Yarnold appear to be taking the position that their Board of Directors has no say on the issue of whether Great Salt Lake is destroyed by using its water to grow subsidized hay for export to China.

Based on her and CEO Yarnold’s behavior in ignoring our 4/24/2018 letter imploring them “to permit any donors we might solicit to contribute directly into a special fund or restricted account with your organization to be used only to finance the litigation” which National Audubon’s glossy fund-raising brochure had promised in order to save Great Salt Lake, this evening’s letter is not surprising. After all, she and CEO Yarnold could hardly claim that each did not receive her/his copy of the letter by FedEx on 4/25/2018.

Now that their behavior has prevented the National Audubon Society from receiving two 8-figure donations to finance the litigation as described in our 6/13/2018 letter to the National Audubon Directors, the denouement described in our letter has been reached -- the National Audubon Board of Directors will have to decide whether to reverse the staff decision and use National Audubon’s own resources to save Great Salt Lake with litigation.

And if the Board fails to take such action, each individual director will be faced with the moral decision of whether to resign.

So yes, we anticipated that the National Audubon staff would re-affirm the position implied by its inaction and silence.

And yes, as we anticipated, “the events of the final chapter of [this] book to be written have yet to occur.”

Thank you for your Good Wishes.

And yes, just like 14 years of my life were devoted to the matters described in "Inner-City Holocaust and America's Apartheid 'Justice' System (In Honor of Jonathan Kozol and in Memory of John Howard Griffen"), a significant portion of the last 2 years of my life were devoted to matters to be described in "The National Audubon Society Executes Great Salt Lake's Death Warrant."

Indeed, the other members of our Great Salt Lake Working Group thought that the National Audubon General Counsel had a lot of Chutzpah in saying that we should just forget about all the work we put into trying to save Great Salt Lake the last two years, only to see the National Audubon Society seize on our work as nothing but a fund-raising opportunity with no intention of doing what their fund-raising brochure promised -- saving Great Salt Lake with litigation.

I hope all is well with you since the end of ski season.

BTW, as our resident expert on all matters nuclear (via, inter alia, your PhD in Nuclear Engineering from the U/Tennessee's Oak Ridge National Nuclear Research Laboratory), I hope you will be proposing at least one "ad hoc topic" during my sabbatical on a nuclear public-policy matter.
