Traditionally, each month’s “Reference Materials” section that follows immediately below, includes not only any articles, research reports, etc. that our members consider relevant, but also book reviews from –

The Wall Street Journal
The Washington Post

An “advanced search” for “Schweizer” from 10/1/2021 to today (4/21/20220) of the websites of each of those three publications demonstrates that none of them has mentioned Schweizer during that time frame, much less published a review of “Red Handed.”

It would be fair to infer that the Peoples Republic of China has forbidden them to publish reviews.

INDEED, a Google search for “Schweizer ‘Red Handed’” disclosed that no more than 3 prominent newspapers/magazines published book reviews, adding to the inference that the PRC can “cancel” information about anything that offends it.

HOWEVER, there is posted in the following "Reference Materials" section one of those book reviews by Britain’s “The Guardian” newspaper which is owned by the Scott Trust to preserve independence.

The author of The Guardian’s book review is simply identified as Lloyd Green who, per https://www.theguardian.com/profile/lloyd-green, is --

“An attorney in New York, Lloyd Green was opposition research counsel to George HW Bush’s 1988 campaign and served in the Department of Justice from 1990 to 1992.”

Our members will recall our abhorrence of how American business commands the free use of our military for corporate purposes.

And how President George HW Bush (1989-1993) launched “Gulf War I” against Saddam Hussein’s Iraq ON BEHALF OF AMERICA’S GULF OIL COMPANY whose crown jewel Kuwait had been suddenly invaded/annexed by Saddam.

To fight Saddam, Bush’s invasion of Iraq was staged principally from Saudi Arabia.

Bush’s stationing American troops in Saudi provoked Osama bin Laden to issue a fatwā (which is STILL a religious duty of every member of Al Qaeda and its off-shoots such as ISIS) TO NUKE 10 MILLION AMERICANS.

How to cope with Osama’s fatwā was the subject of a book by Graham Allison, the Founding Dean of the Harvard Kennedy School of Government – “Nuclear Terrorism: The Ultimate Preventable Catastrophe” (Times Books 8/9/2004).

Graham Allison’s solution of keeping track of the world’s fissile material the way we used to keep track of gold at Fort Knox was rejected by Congress in favor of FISA Sec. 702’s empowerment of our intelligence services to spy on Americans WITHOUT A WARRANT so long as either the Attorney General or DNI labels it a “national emergency.”

HOWEVER, before the Congressional rejection, Dean Allison’s approach was championed by Tim Russert’s Meet the Press, Tom Brokaw, Sam Nunn (D-GA & long-time chair of the Senate Armed Services Committee), Richard Lugar (R-IN & long-time chair of the Senate Foreign Relations Committee) and Tom Kean and Lee Hamilton (Chair & Vice-Chair of the 9/11 Commission).

Article III, Section 3, Clause 1 of the U.S. Constitution says –

“Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the testimony of two Witnesses to the same overt Act, or on Confession in open Court.”

“Sacrificing American strength and security on the altar of personal enrichment” is “giving…Aid and Comfort.”

This raises the question whether the Peoples Republic of China is an “Enemy.”

In addition, the concept of “treason” usually includes a third element – an obligation of allegiance. And many of the individuals who are “sacrificing American strength and security on the altar of personal enrichment” may not be American citizens –

(1) If they are “green card” holders (aka, “lawful permanent residents”) they not only are required to file income tax returns and, if male and aged 18-25, to register for the Selective Service System, but they are also obligated to obey all laws of the United States INCLUDING THE LAW OF TREASON.

(2) If they are otherwise in the U.S. lawfully, there is a myriad patchwork of rules governing status – e.g., student and work visas, whether the visitor is a citizen of a visa-waiver program country such as most European countries, etc., etc.

(3) NB: They may be here illegally because, for example, they are working for, or studying at, an organization that does not thoroughly vet their employees or students. Or because the illegal foreigners who, in the case we are studying, are able with their own resources and/or resources that may be provided by the Peoples Republic of China, to obtain “green cards” or visas with fake identities.

Even for non-citizens in categories (2) and (3), there is still an obligation to obey the laws of the United States – EXCLUDING the law of treason since there is no “obligation of allegiance.”

HOWEVER, they may still be guilty of spying. The Espionage Act of 1917 was enacted upon U.S. entry into World War I.

The current anti-espionage or anti-spying provisions which were substantially revised by The Espionage Act of 1996 can be found in Title 18 U.S. Code Sections 1831-1839, the text of which is available at https://www.govinfo.gov/content/pkg/USC ... itle18.htm by scrolling down to sections 1831-1839.

In general, 18 U.S. Code Sec. 1831 authorizes, inter alia, imprisonment for 15 years for individuals (including BTW U.S. citizens) who for the benefit of, inter alia, “any foreign government” – steals, copies, or receives a “trade secret” which is defined in Sec. 1839 as “all forms and types of financial, business, scientific, technical, economic, or engineering information, including patterns, plans, compilations, program devices, formulas, designs, prototypes, methods, techniques, processes, procedures, programs, or codes, whether tangible or intangible, and whether or how stored, compiled, or memorialized physically, electronically, graphically, photographically, or in writing…..”

Conclusion???

American citizens and “green card” holders are probably guilty of treason if the Peoples Republic of China is an “enemy.”

American citizens and “green card” holders AND EVERYONE ELSE are guilty of espionage, aka spying, if they steal/copy/receive a “trade secret” for the benefit of the Peoples Republic of China – since espionage, aka spying, does NOT require that the foreign government be an “enemy.” NB that, as mentioned above vis-à-vis Sec. 1839, their maximum imprisonment per count is 15 years.

The punitive articles of the UCMJ are contained in 10 U.S. Code Sections 877-934. They include –

Sec. 903 – Spies. [This section requires “time of war.”]
Sec. 903(a) – Espionage. [This section essentially parrots the provisions of The Espionage Act – 18 U.S. Code Sections 1831-1839.]
Sec. 903(b) – Aiding the Enemy. [This section requires an “enemy.”]

Conclusions???

Only Sec. 903(a)-Espionage clearly applies since there is no requirement for a “time of war” and no requirement that the Peoples Republic of China be an “enemy.”

HOWEVER, Sec. 903(a) GOES FARTHER than The Espionage Act (18 U.S. Code Sections 1831-1939) which applies to both civilian and military personnel BECAUSE SEC. 903(a) AUTHORIZES CAPITAL PUNISHMENT –

“…..shall be punished as a court-martial may direct, except that if the accused is found guilty of an offense that directly concerns (A) nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large scale attack, (B) war plans, (C) communications intelligence or cryptographic information, or (D) any other major weapons system or major element of defense strategy, the accused shall be punished by death or such other punishment as a court-martial may direct.”
