Dear Friends,

Our next meeting is Wed December 10 – 6:30 pm - 8:30 pm MST via Zoom.

We will at that time judge between Dartmouth College and Rutgers U re whether Mark Bray’s “Antifa Handbook” describes Antifa as a Domestic Terrorist Organization as defined in 18 U.S. Code Sec. 2331(5).

DARTMOUTH COLLEGE LECTURER IN HISTORY MARK BRAY

He published “Antifa: The Anti-Fascist Handbook” on 8/14/2017.

His only academic degree at that time was a Bachelor of Arts (BA) in Philosophy from Wesleyan University (2005).

Previous experience per the “Antifa Handbook” included being “a core organizer of the Press Working Group of Occupy Wall Street.”

Per Wikipedia – “Occupy Wall Street (OWS) was a left-wing populist movement against economic inequality, capitalism, corporate greed, big finance, and the influence of money in politics. It began in Zuccotti Park, located in New York City's Financial District, and lasted for fifty-nine days—from September 17 to November 15, 2011…..The protesters were forced out of Zuccotti Park on November 15, 2011. Protesters then turned their focus to occupying banks, corporate headquarters, board meetings, foreclosed homes, college and university campuses, and social media.”

And further per Wikipedia – “On October 13…..some protesters clashed with police in riot gear outside City Hall…..on November 15, 2011, the New York City Police Department gave protesters notice from the park's owner to leave Zuccotti Park…..About an hour later, police in riot gear began removing protesters from the park, arresting some 200 people in the process, including a number of journalists.”

In 2013, Mark Bray published “Translating Anarchy: The Anarchism of Occupy Wall Street,” socio-political analysis of the Occupy Wall Street movement based on 192 interviews with organizers.

DARTMOUTH COLLEGE OFFICIAL DENUNCIATION OF THE ANTIFA HANDBOOK

Statement on Lecturer in History Mark Bray by the President of Dartmouth (https://home.dartmouth.edu/news/2017/08 ... -mark-bray) --

8/21/2017

“Recent statements made by Lecturer in History Mark Bray supporting violent protest do not represent the views of Dartmouth. As an institution, we condemn anything but civil discourse in the exchange of opinions and ideas. Dartmouth embraces free speech and open inquiry in all matters, and all on our campus enjoy the freedom to speak, write, listen, and debate in pursuit of better learning and understanding; however, the endorsement of violence in any form is contrary to Dartmouth values.”

PRES. TRUMP’S 9/22/2025 EXECUTIVE ORDER DESIGNATING ANTIFA AS A DOMESTIC TERRORIST ORGANIZATION AS DEFINED IN 18 U.S. CODE SEC. 2331(5)

The Executive Order is available at https://www.whitehouse.gov/presidential ... anization/

18 U.S. Code Sec. 2331(5) states --

the term “domestic terrorism” means activities that—

(A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;

(B) appear to be intended --

(i) to intimidate or coerce a civilian population;
(ii) to influence the policy of a government by intimidation or coercion; or
(iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and

(C) occur primarily within the territorial jurisdiction of the United States;

MARK BRAY AT RUTGERS U.

Earned a Doctor of Philosophy (PhD) in History from Rutgers University (2016).

As of his abandoning Rutgers 10/9/2025 and fleeing to Spain, the Rutgers University website reported that --

• He was an Assistant Teaching Professor of History;

• His courses included –

 History Workshop: Antifascism
 History Seminar: Anarchism
 History Seminar: Communism
 SAS Honors Interdisciplinary Seminar: Occupy Wall Street
 Terrorism

********************
THE RUTGERS STATEMENT ISSUED IN THE WAKE OF MARK BRAY’S DEPARTIRE

“Rutgers University is committed to providing a secure environment — to learn, teach, work, and research, where all members of our community can share their opinions without fear of intimidation or harassment. Rutgers is committed to upholding the rights of students and faculty to free speech and academic freedom as fundamental to our community.”

OBSERVATIONS ON RUTGER’S STATEMENT RE “FREE SPEECH”

One of the first things a law-school student learns is that FREEDOM OF SPEECH DOES NOT INCLUDE THE RIGHT TO FALSELY SHOUT “FIRE” IN A CROWDED THEATER.

And then s/he studies zillions of other limitations on “freedom of speech” such as defamation and such as incitement to riot!!!

A comprehensive review is provided by the U.S. Library of Congress.

The Library of Congress was founded 4/24/1800 and serves as the research arm of the U.S. Congress.

Vis-à-vis the First Amendment to the Constitution, the LOC’s analysis of legal cases at https://constitution.congress.gov/browse/amendment-1/ includes 95 Reports on the “Freedom of Speech” Clause of the First Amendment of the U.S. Constitution which provides --

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

IMHO the appropriate Library of Congress Reports among the 95 for our purposes are --

Amdt1.7.5.4 - Incitement Current Doctrine at https://constitution.congress.gov/brows ... _00013805/

Amdt1.7.5.5 - Fighting Words at https://constitution.congress.gov/brows ... _00013806/

Amdt1.7.5.6 - True Threats at https://constitution.congress.gov/brows ... _00013807/
